1. Scope of Services
A2Z Environmental LLC ("the Company") offers asbestos-related services including but not limited to inspections, air sampling, abatement planning, and incident assessments in accordance with New York State Code Rule 56 and other relevant regulations.
2. Client Responsibilities
- The client agrees to provide necessary access to the premises for inspections and abatement work as required by the Company.
- The client will ensure that any occupants or personnel are informed about the asbestos-related activities as advised by the Company.
3. Service Limitations
The Company's services are limited to asbestos-related assessments, inspections, and recommendations. Any abatement work shall be performed by licensed contractors as per regulatory requirements.
4. Compliance with Regulations
The Company operates in compliance with NYS Code Rule 56, OSHA, EPA, and other relevant regulations. The client acknowledges and agrees to comply with these regulations as applicable to their premises.
5. Limitation of Liability
The Company shall not be held liable for any indirect, consequential, or incidental damages arising from the use of its services, except where prohibited by law.
6. Confidentiality
All information obtained during the provision of services shall be treated as confidential and will not be disclosed to third parties without the client's consent unless required by law.
7. Payment Terms
Payment for services rendered shall be made as per the terms specified in the invoice. Failure to make payment within the agreed-upon timeframe may result in additional fees or suspension of services.
8. Cancellation and Rescheduling
Cancellation or rescheduling of appointments must be communicated to the Company at least 24 hours in advance. Failure to do so may result in a cancellation fee.
9. Indemnification
The client agrees to indemnify and hold harmless the Company, its employees, and agents from any claims, liabilities, damages, or expenses arising from the client's failure to comply with these terms or from the use of the Company's services.
10. Governing Law
These terms and conditions shall be governed by and construed in accordance with the laws of the State of New York.
11. Agreement Acceptance
The client acknowledges having read and understood these terms and conditions and agrees to be bound by them upon engaging the Company's services.
